Time Loss Compensation

The Department of Labor & Industries or a Self-Insured employer is required to pay injured workers a portion of their regular wages. These benefits are called time loss compensation or Loss of Earning Power benefits. These payments are approximately 60 to 75 percent of your regular wages, depending on your marital status and number of children. Payments are capped at a certain level, based on the state's average wage, which changes annually.

How to Qualify

To be eligible for time-loss compensation, your doctor must certify that you are unable to work and file the appropriate paperwork and wage claim information with the Washington State Department of Labor & Industries.

When Will I be Paid

If your claim is approved, the Department of Labor & Industries or Self-Insured employer should send your first check 14 days after receiving your doctor's report. You will continue to be paid every two weeks as long as your doctor continues to certify that you are unable to work. Loss of Earning Power is payable when you are released to return to work with restrictions. Your doctor may restrict you from working full time and may request that you return to work on a transitional basis or in a light duty position. If that is the case, Loss of Earning Power benefits are payable.

Time loss should continue until you are able to return to work in some capacity. Loss of Earning Power benefits are payable until such time that you are able to return to work in the same capacity prior to your injury.
