If your worker's compensation claim has been allowed through the Washington State Department of Labor & Industries' State Fund program, all treatment received will be paid for through the Department of Labor & Industries. However, if your employer is Self-Insured, they more likely than not will have a private carrier who handles their claims. If this is the case, the medical provider will bill the private carrier directly for payment. Whether your employer is insured through the State Fund or is Self-Insured, you have the right to select your own doctor or chiropractor as long as he or she is qualified to treat your condition and has a provider number through the Department of Labor & Industries. You have a right to change attending physicians if you do not feel that you are receiving the appropriate treatment.

In addition to paying for your medical treatment, the Department of Labor & Industries or Self-Insured employer will compensate you for travel. However, travel expense reimbursement is only payable when you do not have medical providers within 10 miles of your home. If you are required to travel more than 10 miles for treatment, travel reimbursement would be payable at the current rate.

Every 30 days, your doctor must recertify that you are unable to return to work in order for you to continue receiving time loss compensation.

Your doctor will determine if and when you are capable of returning to work and what types of physical restrictions you should observe. You can ask your employer if you can do your old job, with some accommodations, or if other, light-duty work is available. You may also be referred for vocational rehabilitation.

Once your doctor certifies that you have reached maximum medical improvement, are medically fixed and stable and that you are able to work in some capacity, the Department of Labor & Industries or Self-Insured representative will move forward to claim closure. You will be scheduled for an Independent Medical Evaluation to ascertain whether you have a permanent impairment caused by the industrial injury. You may recover compensation if you have sustained a permanent partial disability (PPD).
